The Police have issued a public notice regarding the attachment of property belonging to individuals who evade arrest despite warrants being issued against them.
According to the Police, the Code of Criminal Procedure Act No. 15 of 1979 provides courts with the authority to take legal action against individuals who remain in hiding or otherwise evade the law, thereby preventing the execution of a court-issued arrest warrant.
Under Section 60 of the Code of Criminal Procedure, when a court is satisfied that a person against whom a warrant has been issued is evading arrest, it may issue a written proclamation requiring the individual to appear before the court at a specified place and time.
The proclamation must provide a period of not less than 30 days for the person to appear before the court.
If the individual fails to appear within the specified period following the issuance of the proclamation, the court may, under Section 61 of the Code of Criminal Procedure, issue an order for the attachment of the person’s movable or immovable property, the Police said.
The Police urged the public to be aware of these legal provisions concerning individuals who evade arrest and court proceedings.
